Non-Forfeiture of Payments

CONDOMINIUM AND SUBDIVISION BUYER’S RIGHT FAILURE TO PAY INSTALLMENTS

SECTION 23 OF P.D. 957:

States that a project owner or developer cannot forfeit a buyer’s payment for a subdivision lot or condo unit when

the buyer after due notice stops paying for it because the project has not been developed according to plans and

within the time limit allowed by DHSUD.

Likewise, the buyer has the option to demand a refund of the total amount paid with legal interest. This amount

includes amortization interest but excludes delinquency interest.

Buyers may file a verified complaint before the Human Settlements Adjudication Commission for the violation of

the said right/s.
